POSSESSORS OF THE RIGHT TO PROCREATIONAL AUTONOMY ...

Nevertheless, it might be easier to justify the denial of this right for men than for women living in homosexual relationships. So a lesbian can procreate or by having sex with a man cooperative or by artificial insemination from donors, a homosexual can only procreate by using the services of a surrogate mother. Although the law is not likely to prohibit the use of surrogate mothers to heterosexual couples where the surrogate mother is a substitute for the woman who would bring the child if she was not sterile, it can be morally acceptable for the law to discourage or even prohibit the use of surrogate mothers morally troubling, where the infertility of a heterosexual couple is not involved. If it seems unfair to deny homosexuals the right to procreate when lesbians are allowed to enjoy it, it must be remembered that reproductive decisions are generally much lower for men than for women. This is not only or even primarily because in our society to procreate and maintain are less central to their self-images. Unlike a woman, a man can never give more meaning to his life carrying a fetus to term and delivering a child. We can not all men need the freedom to decide whether or not abortion. Therefore, the interest of the State to minimize the use of surrogate mothers could be sufficient to justify the denial of the constitutional right to reproductive autonomy for adult males living in stable relationships gay.
